11. TRANSPORTATION…………………………BUYER TO SUPPLY FIRST CLASS COMPLETE GROUND TRANSPORTATION TO & FROM CLUB & OFFICE

12.  ACCOMMODATIONS………………………..N/A

13.  If BUYER refuses or neglects to provide any of the items stated or fails or refuses to make any of the  payments as provided or proceed with the engagements, ARTIST shall have no obligation to perform this contract and shall retain any amounts therefore paid to ARTIST or on his behalf by BUYER and BUYER shall remain liable to ARTIST for contract price set forth.

14.  In the event of sickness or accident to the ARTIST or if the performance is prevented, rendered impossible or infeasible by an act of or regulation of any public authority or bureau, civil tumult, strike, epidemic, interruption in or delay of transportation services, war conditions or emergencies or any cause beyond the control of ARTIST, it is understood and agreed that there shall be no claim for damages by either party to this contract and ARTIST(s) obligation as to such performance shall be deemed waived.  In the event of such non performance for any of the persons stated in this paragraph, the monies (if any) advanced to ARTIST shall be returned on a pro-rate basis by show.  Inclement weather rendering performance impossible or infeasible shall not be deemed an emergency and payment of the agreed upon price shall be made provided that the ARTIST is ready and willing and able to perform.

15.  It is agreed that ARTIST signs this contract as an independent contractor and not as an employee and he shall have the exclusive control over the means and methods employed on fulfilling his obligations.  This contract shall not, in any way,  be construed so as to create a partnership or any other kind of joint undertaking or venture between the parties hereto.

16.  No recording of performance allowed either by radio,  Film, TV, Video or Record without prior consent from ARTIST.

17.  ARTIST name or likeness may not be used as an endorsement of any product or service in connection with any commercial tie-in without ARTIST written consent.

18. It is understood and agreed upon by BUYER that any deposits made shall be non-refundable unless the fault lies in the ARTIST.

19.  If rider is attached then rider is hereby made a part of this contract and must be signed by all parties concerned.

20.  This contract cannot be assigned or transferred without the written constant of ARTIST.  It contains the complete understanding of the parties hereto and may be amended, supplemented, varied or discharged except by writing. This contract is not binding until executed and delivered by both parties.

21.  ARTIST reserves the right upon 20 days notice to cancel the engagement in the event ARTIST has been retained to appear in a Motion Picture, Television Motion Picture, Television Series or Special and or any Las Vegas, Tahoe, Reno, Atlantic City or any other type of casino operation.

22.  If BUYER should cancel date with less than two weeks notice, ARTIST must be compensated with 50% of agreed upon amount.

23. If BUYER should cancel date with less than twenty four hours notice, ARTIST must be paid in full for agreed upon amount.
